We’ll take action against entities that may have used the licensor’s publications without authorization in the past. The goal here is to recover damages for any unauthorized use by AI companies.
The Magazine Coalition will have the right to “investigate, pursue, enforce, and take legal action… against any third party… alleged to be infringing the copyrights in the Licensed Content… through unauthorized reproduction, distribution, display, or use in AI training or output”.
Any monetary “Recoveries” obtained from these enforcement actions (whether through settlements or judgments) will be distributed according to participating publishers.
We’ll focus on prospectively licensing publications to AI developers and platforms. This allows AI to use content for specific, defined purposes, primarily for training their AI models and for displaying excerpts within their platforms.
In short, we’ll look back to address existing unauthorized use and recover any missed value. We’ll also look ahead to enable authorized use and generate ongoing licensing revenue.
